Terms and Conditions - Sydney - Masterstone

Quotations:

Unless previously withdrawn, a Quotation is valid for thirty (30) days.

Payment Terms:

Deposit of 10% of total price payable upon acceptance of quote.
Further deposit of 40% of total price payable on final measurement.
Balance payable upon delivery, pick up, or installation unless prior Arrangements are made with management.
Account/Credit applications for 14 or 30 days are available for businesses only.
All credit accounts are conditional on acceptance of our Terms and Conditions, therefore Late payment fees and collection costs would be sought.
Payments can be made by cash, checks or direct debit.

Default of Buyer:

If the Buyer defaults by non-payment or non-performance of any obligations under this agreement or if any proceedings under any bankruptcy, liquidation or insolvency laws are commenced by or against the Buyer, the Seller will have the right to exercise any of the following remedies:
Declare all unpaid charges to be immediately due and payable;
Take possession without demand or notice (the right to demand or notice the Buyer hereby expressly waives) of all parts of the Goods as yet unpaid for;
Terminate this Agreement in whole or in part; and or Pursue any other remedies existing at law or in equity.
In addition to any other payment obligations hereunder, the Buyer agrees to pay to the Seller all costs and expenses including legal fees, debt collecting agency fees and commissions and all other costs incurred by the Seller in exercising any of its rights and remedies.
Interest on overdue invoices shall accrue daily from the date when payment becomes due until the date of payment at a rate of 2.0% per month and shall continue to accrue at such rate after as well before any judgement.
An Account Keeping Fee will be charged on unpaid invoices that fall outside our trading terms.

Privacy Act 1988

a) The Buyer and / or Guarantor/s agree for the Seller to obtain from a credit-reporting agency a credit report containing personal credit information about the Buyer and Guarantor/s in relation to credit provided by the Seller.
b) The Buyer and or Guarantor/s agree that the Seller may exchange information about the Buyers and Guarantor/s with those credit providers named in the Application for Credit Account or named in a consumer credit report issued by a reporting agency for the following purposes:
1) To assess an application by the Buyer
2) To notify other credit providers of a default by the Buyer
3) To exchange information with other credit providers as to the status of this credit account, where the Buyer is in default with other credit providers; and
4) To assess the credit worthiness of the Buyer and Guarantor/s.
c) The Buyer consents to the Seller being given a consumer credit report to collect overdue payments on commercial credit (Section 18K(1)(h) Privacy Act 1988
c) The Buyer agrees that the Personal data provided may be used and retained by the Seller for the following purposes and for other purposes as shall be agreed between the Buyer and Seller or required by law from time to time:
1) Provision for services and goods.
2) Marketing of services and Goods by the Seller, its agents or distributors in relation to the services and goods via email or other means.
3) Analysing, verifying and/or checking the Buyers credit payment and/or status in relation to the services and goods
4) Processing of any payment instructions, direct debit facilities and/or credit facilities requested by the Buyer, and
5) Enabling the daily operations of Buyer’s account and/or the collection of amounts outstanding in the Buyer’s account in relation to services and goods.
e) The Seller may give. Information about the Buyer to a credit reporting agency for the following purposes;
1) to obtain consumer credit reports about the Buyer and or
2) allow the credit-reporting agency to create or maintain a credit information file containing information about the Buyer.
f) The Buyer agrees that any Credit card details which are provided to the Seller to pay for services and Goods, gives the Seller the right to retain the credit card information solely for the purpose of paying for future services and or goods.
